Terms of Sales
Article 1 - Scope
These general conditions of sale constitute, in accordance with article 441-6 of the French Commercial Code, the sole basis of the commercial relationship between the parties. Their purpose is to define the conditions under which LES FRANCHOUILLARDS SAS ("the Supplier") provides purchasers who place an order ("the Purchaser") with products sold under the LE ZIP PAR LES FRANCHOUILLARDS brand via the website www.le- zip.com and in particular: masks and caps ("the Products").
They apply without restriction or reservation to all sales of Products concluded by Buyers to the Supplier, and prevail over all other conditions, in particular the Buyer's general purchasing conditions. Any order for Products implies unreserved acceptance by the Purchaser and his adherence to these general conditions of sale.
These general conditions may be modified at any time and without notice by the Supplier, the applicable conditions being those in force on the date of the order by the Purchaser.
Article 2 - Order
Any order will only be validated after payment has been accepted.
It is up to the Purchaser to select on the site the products he wishes to order. Payment is made online and will be confirmed by email specifying: the references ordered, the amount of the order, the delivery address. The order will be shipped within 5 days of receipt of payment at the latest, unless otherwise specified.
Article 3 - Payment
Full payment must be made when ordering. At no time can the sums paid be considered as a deposit or down payment. The Buyer pays for his order by credit card (Visa, Eurocard / Mastercard). Cheques are not accepted.
Purchases are made in a secure manner, all payment information exchanges are made via an encrypted connection. For payments by credit card (credit card, visa credit card and e-credit card), all the information that the Purchaser communicates to the Supplier or to its payment partners is strictly protected and guarantees the compliance and security of each subsequent transaction. applicable regulations.
For any transaction, the Purchaser will indicate the number appearing on the front of his card, the expiration date of his card and the cryptogram appearing on the back of his card (last three digits).
The communication by the Purchaser of his bank card number constitutes authorization for the Supplier to debit his account up to the amount of his order. The banking information communicated by the Purchaser when placing an order is neither stored nor visible on the internet. Through its security system, the Purchaser certifies the confidentiality of these banking data.
In application of the Data Protection Act of January 6, 1978, the Purchaser can exercise his right of access, rectification, and opposition to all of his banking data by sending a letter, subject to justifying his identity, to the Supplier at the following address: LES FRANCHOUILLARDS, 13 rue des Danys, 06110 Le Cannet.
No cash on delivery will be accepted, whatever the reason.
Article 4 - Delivery and Transport
The Products acquired by the Purchaser are shipped with the delivery slip, to the delivery address indicated by the Purchaser when ordering. Delivery cannot be made to hotels or PO boxes. The delivery times indicated on the site are indicative times, corresponding to the average processing and delivery times.
The Purchaser is required to check the apparent condition of the Products upon delivery. In the absence of written reservations expressly made by the Purchaser within 48 hours of delivery to the Supplier, the Products delivered by the Supplier shall be deemed to comply with the order in quantity and quality. No complaint can be validly accepted in the event of non-compliance with these formalities by the Purchaser.
The Supplier shall replace as soon as possible and at its expense the Products delivered whose lack of conformity has been duly proved by the Purchaser. In the event of a delivery delay of more than 14 working days, if the product has not been shipped, the Buyer may terminate the order by registered letter with acknowledgment of receipt and request reimbursement of his order.
Article 5 - Right of withdrawal
Right to retract:
Within 14 days of receipt of his order, the Buyer may request the Supplier to return the Product (s).
The return costs are the responsibility of the Buyer.
The Product must be returned in its original packaging, in its original condition, new, unworn, unwashed, indicating the reason for refusal on the delivery slip or invoice. The Buyer must also indicate whether he wishes to exchange the product with a similar one or the cancellation and refund of the order.

If the Purchaser fails to comply with these conditions, in particular the return conditions, the Supplier cannot refund, exchange or issue a credit note for the Products concerned.
Article 6 - Price
The price of the Products is expressed in euros and includes all taxes, excluding the cost of processing, shipping and packaging. The shipping costs (including the costs of processing, shipping and packaging) will be indicated in the Buyer's basket, before the final validation of the order.
Customs duties or other local taxes or import duties or state taxes may be payable for products shipped outside the European Union. These rights and sums are not the responsibility of the Supplier, they will be the responsibility of the Purchaser.
Prices are subject to change at any time without notice. The items will be invoiced on the basis of the rates in effect at the time the order is placed.
Article 7 - Guarantee
The Products delivered by the Supplier benefit from the guarantees provided for by law from the date of delivery, covering the non-conformity of the products with the order and any hidden defect resulting from a material design or manufacturing defect affecting the delivered Products. and rendering them unsuitable for use. The warranty forms an inseparable whole with the Product sold by the Supplier. The Product may not be sold or resold altered, transformed or modified. This warranty is limited to the replacement or reimbursement of non-compliant or defective Products. Any warranty is excluded in the event of misuse, negligence or lack of maintenance on the part of the Purchaser, such as normal wear and tear of the Product or force majeure. In order to assert his rights, the Purchaser must, on pain of forfeiture of any action relating thereto, inform the Supplier in writing of the existence of the defects within a maximum period of 15 days from their discovery. The Supplier shall replace or have repaired the Products or parts under warranty deemed to be defective.
Article 8 - Intellectual property
All the elements and information (in particular, without this being exclusive, the texts, drawings, images, logos, brands, etc.) present on the Supplier's Site are protected by intellectual property rights and may not be reproduced or used without the prior written consent of the latter. Any reproduction without the authorization of the Supplier constitutes an infringement.
Article 9 - Force Majeure
The Parties shall not be liable for the non-performance of their obligations in the event of the occurrence of a case of force majeure, defined as any unforeseeable, irresistible event resulting from circumstances external to the Parties, making it impossible to perform the Contract.
All the obligations of the parties will be suspended for the duration of the force majeure event, without compensation.
If the force majeure event continues for more than three (3) months, the contract concerned may be terminated automatically without compensation for either party.
Article 10 - Automatic termination clause
In the event of non-performance of its obligations by one party, this contract will be terminated automatically in favor of the other party without prejudice to any damages that could be claimed from the defaulting party. The resolution will take effect 30 days after sending an unsuccessful formal notice by AAR letter.
Article 11 - Settlement of disputes - Applicable law
These general conditions of sale will be governed by French law. All disputes to which this contract may give rise concerning its validity, interpretation, execution, termination, their consequences and their consequences will be submitted to the competent courts within the jurisdiction of the Aix-en-Provence Court of Appeal.
